Court of Appeal ruled on the applicable limitation period in adverse possession cases

2 October 2019 – In this important decision (Tang Moon Lam v Tang Ying Yeung [2019] 5 HKLRD 556) the Court of Appeal removed doubts on previous inconsistent decisions, and decided authoritatively the applicable limitation period applicable in adverse possession cases straddling the amendment in 1991, which shorteed the limitation period from 20 years to 12 years.
