Lewis Law and Ching Him Ho acted for the successful applicant in Kwan Yui Huen v Secretary for Justice [2023] HKCFI 1056


In Kwan Yui Huen v Secretary for Justice [2023] HKCFI 1056, the Court of First Instance granted relief to the applicant to file his election return out of time on the ground of inadvertence pursuant to Section 40(1) of the Elections (Corrupt and Illegal Conduct) Ordinance (Cap 554).


The Court once again highlighted the difference between "inadvertence" and "an act or omission so unreasonably careless or negligent" even if the line is not crossed into bad faith.
